Woman claims her husband did not allow her to eat chips – Karnataka High Court comes to his rescue

BENGALURU: The Karnataka High Court came to the rescue of a man by allowing him to return to the United States to save his job and staying the proceedings filed against him by his wife for claiming that he did not allow her to eat French fries.

The Basavanagudi police had issued a LOC (Look Out Circular) to the 36-year-old husband on the complaint of his 29-year-old wife in the city. Hearing the husband’s petition, Justice M Nagaprasanna said allowing any investigation against the husband would be an abuse of the legal process and would add further emphasis to the wife’s trivial allegations. Till the next hearing, all further investigations are temporarily stayed, the judge said.

The judge said it was surprising how the CA could issue the LOC based on trivial circumstances. This was an abuse of power at the behest of the plaintiff. The plaintiff’s sole aim appears to be to prevent the plaintiff from returning to the US. “I consider it appropriate to allow the husband to continue his employment in the US… The CA should immediately inform the immigration office of the husband’s trip and not prohibit or bar him from entering the US,” the judge said.

According to the injunction, the husband came during his vacation only to receive the complaint filed by his wife against him and his family members.

The husband turned to the court because he is about to lose his job. The court explained that the allegations in the lawsuit relate to minor disputes that occur in everyday life between husband and wife.

The court quoted the wife’s complaint and stated that she claimed she suffered from high blood pressure when she gave birth to her child and her husband forbade her from eating French fries, rice and meat because otherwise she would gain weight. The husband complained that he did all the housework while she was in the US, while the wife only watched TV and talked to her family on the phone outside of TV. He said he washed the dishes, cleaned the house and then went to work.
